1. Scope

1.1 Applicability of these Terms and Conditions

These Terms and Conditions apply to all contracts and services of atelier yuniku KlG, Brahmsstrasse 76, 8003 Zürich, in connection with the use of the atelier and the services offered, including courses, workshop use, events, workshops, memberships and all related services. By registering and using our services, members and customers agree to these Terms and Conditions. These Terms also apply to all further amendments and additions to the agreement, unless expressly amended by atelier yuniku or unless deviating provisions are established.

1.2 Services offered

These Terms relate to all services offered by atelier yuniku, including the use of the workshops, participation in courses and workshops, the provision of materials and equipment, as well as all special events and services offered within the atelier.

1.3 Definition of user groups

These Terms apply to the following user groups:

  • Members: persons who acquire a membership in order to regularly access the workshop and its equipment.
  • Course/workshop participants: persons who register for specific courses or workshops without holding a permanent membership.
  • Visitors/guests: persons who enter the atelier on a one-off basis or take part in special events.
  • Cooperation partners/sponsors: third parties who collaborate with atelier yuniku in connection with events, courses or sponsoring.

1.4 Applicability towards third parties

These Terms also apply to third parties acting in connection with the use of atelier yuniku’s services, such as external course instructors, material suppliers and event organisers. Users are responsible for the actions of these third parties insofar as they act in connection with the use of atelier yuniku’s services. These Terms extend to all services and agreements provided or influenced by third parties in a contractual relationship with atelier yuniku.

2. Conclusion of contract

2.1 Formation of the contract

The contract between atelier yuniku and the customer is formed upon confirmation of the membership, booking of a course or participation in a workshop by atelier yuniku. The registration of a member or customer for a course, a membership or an event becomes legally binding through written confirmation (e.g. by email or in paper form) from atelier yuniku.

2.2 Registration and booking

By registering or booking courses, workshops or other events, the customer places a binding order. The contract becomes binding upon confirmation by atelier yuniku. By entering the required data and accepting these Terms, the customer agrees to them and confirms that all data provided is truthful and complete. Should the information turn out to be incorrect or incomplete, atelier yuniku reserves the right to terminate the contract or refuse the membership.

2.3 Correct entries and binding effect

With the booking, the customer confirms that all entries are correct and accepts the Terms of atelier yuniku. The customer undertakes to complete the purchase or booking after confirmation by atelier yuniku and to pay the corresponding amount.

2.4 Changes and cancellations

Changes and cancellations by the customer are free of charge as long as the booking has not yet been confirmed by atelier yuniku. After confirmation by atelier yuniku, the customer understands that atelier yuniku has already incurred costs. Cancellations and refunds are governed by our separate Cancellation Policy.

3. Registration and membership

3.1 Membership registration

Membership with atelier yuniku is applied for via the online form or in writing. The contract is formed upon confirmation of the registration by atelier yuniku. Confirmation is provided in writing (email or paper).

3.2 Types of membership

atelier yuniku offers the following memberships:

  • Individual membership
  • Family membership (for parents with children under 10 years of age)
  • Membership with volunteering functions

Depending on the type of membership, different rights and obligations may apply.

3.3 Start and duration of membership

The membership begins upon confirmation by atelier yuniku and is renewed quarterly. Cancellation must be given 30 days before the end of the quarter. For annual memberships, cancellation is possible up to 3 months before expiry.

3.4 Obligations of the member

Members undertake to keep the workshop and facilities clean, not to let strangers into the atelier without prior registration, and to comply with the code of conduct and the house rules. For memberships with volunteering functions, additional tasks such as supervision or plant care may apply.

3.5 Rights of the member

Members are entitled to discounts on courses and preferential booking rights. In addition, members may register one guest per month, who may use the atelier free of charge up to three times for three hours each (materials and services must be paid for by the guest).

3.6 Membership fees and payments

Fees are due at the start of the membership and may be paid monthly, quarterly or annually. In the event of late payment, reminder fees will be charged, and the membership may be suspended or terminated.

3.7 Code of conduct and house rules

All members must comply with the code of conduct and the house rules, which are provided separately. The aim is a respectful and harmonious coexistence.

3.8 Transferability of membership

The membership is not transferable.

3.9 Changes to membership terms

atelier yuniku reserves the right to amend the terms after prior notice. Members have 30 days to object to the changes; otherwise they are deemed accepted.

4. Use of the workshops and rooms

4.1 General use

The workshops and atelier rooms are accessible only during the set opening hours. We ask members to work quietly during quiet periods so as not to disturb others. Personal items such as jackets, handbags or ongoing projects should be kept compactly with you or stored in the designated storage areas. Personal items must not block the work area, so that all members can use the space efficiently.

4.2 Rights of use

With the membership, members receive the right to use the workshops and the facilities provided during the set times of use. Members also have the right to store their materials and works in the workshops, provided this is done in accordance with the agreed storage guidelines and in compliance with the safety regulations. The use of tools, machines and materials is subject to the operating instructions and training requirements of atelier yuniku.

4.3 Access to the workshops

Access to the workshops is permitted only after an introduction and, where applicable, training in the handling of the machines and tools. Members must be trained in the safe and responsible use of the workshops and their equipment before using the workshops. The workshops may be closed at any time due to maintenance work, training or other organisational reasons, and atelier yuniku will inform members in advance.

4.4 Reservations and booking of the workshops

Use of the workshops is generally possible only after prior booking and confirmation by atelier yuniku. Reservation of the workshops is made via atelier yuniku’s booking system, and the times of use must be strictly observed. Members may use workshops only for the intended purpose and are obliged to leave the workstations in proper condition at the end of use.

4.5 Members’ obligations when using the facilities

Members are obliged to keep the workshops and rooms clean and tidy when using them. All tools, machines and materials must be properly cleaned after use and returned to their designated place. Members must ensure that no dangerous substances or pollutants enter the workshops or rooms and are obliged to report any damage or incidents immediately.

4.6 Safety precautions

The safety of members and users has the highest priority. All members are obliged to comply with atelier yuniku’s safety requirements and guidelines. This includes, among other things, wearing the prescribed protective clothing (e.g. safety goggles, gloves) and following the emergency procedures. The use of machines and equipment without appropriate training and instruction is strictly prohibited.

4.7 Supervisory duties and responsible conduct

Depending on the type of membership, additional supervisory duties may be required, in particular for members acting as supervisors or mentors as part of their membership. These members are responsible for ensuring that the workshops are used correctly and that no danger arises to other members or to the material.

4.8 Use of machines and tools

All machines and tools provided by atelier yuniku must be used with the utmost care and in accordance with the manufacturer’s instructions or atelier yuniku’s standards. Should a member or guest damage or misuse a machine or tool, they bear the cost of repair or replacement. The operation of machines and equipment for which no proper instruction has been received from atelier yuniku is not permitted.

4.9 Guest use

Members are entitled to register one guest per month, who may use the workshops under the same conditions as the member, but only after prior approval and registration with atelier yuniku. Each guest may visit the workshop a maximum of three times for three hours each per month. Costs for the guest’s materials and services are to be borne by the guest. Guest use is possible only in the company of a member and within regular opening hours.

4.10 Restrictions on use

Use of the workshops is limited to the personal use of the members. Commercial activities, the manufacture of products for sale or the operation of a trade within the workshops are not permitted without the express authorisation of atelier yuniku. Any illegal or harmful use, including the manufacture of dangerous or impermissible materials, is strictly prohibited.

4.11 Changes and closures

atelier yuniku reserves the right to change the terms of use for the workshops, to increase usage restrictions or to close the workshops for certain activities where this is necessary for reasons of safety, maintenance or improvement of the workshops. Such changes or temporary closures will be communicated to members in good time.

4.12 Liability

atelier yuniku is not liable for damage arising from improper use of the workshops, machines or tools, unless the damage was caused by gross negligence or intent on the part of atelier yuniku. Members are obliged to check their own liability insurance to ensure that it also covers the use of workshops and machines.

4.13 Loss of or damage to property

atelier yuniku accepts no liability for the loss of or damage to private property that members keep in the workshops or rooms. Members are responsible for their own materials and tools and should store them properly and securely.

5. Prices and payments

5.1 Prices for memberships and services

The prices for memberships and all additional services, such as courses, workshops and material use, are published on the atelier yuniku website as well as in the respective contract documents. All prices are in Swiss francs (CHF) and include statutory VAT, unless otherwise agreed.

5.2 Payment terms

Members are obliged to pay all membership fees and additional costs on time. Payments for memberships are made annually or monthly, as agreed. The membership fee is due in advance by the 1st of the respective month or year at the latest.

Courses and workshops are likewise to be paid in advance to secure participation. Payments can be made by bank transfer, credit card or other payment methods accepted by atelier yuniku. Payments must be received within the period stated on the invoice.

5.3 Default and reminder fees

Should a payment not be made within the deadline, the membership fee or course fee is considered overdue. atelier yuniku reserves the right to charge reminder fees of CHF 10 for each reminder, as well as default interest of 5% p.a. on the outstanding amount. In the event of repeated default, atelier yuniku may suspend the membership or participation in courses and workshops.

6. Liability and insurance

6.1 Liability for use of the workshops

Use of the atelier is at your own risk. atelier yuniku is not liable for damage incurred by members or their property during use of the atelier, unless atelier yuniku caused the damage intentionally or through gross negligence. Members must keep an eye on their personal belongings at all times and may store them in the communal areas at their own risk.

6.2 Liability in the event of accidents

Members are obliged to look after their own safety and to follow all instructions for using the workshops and equipment. atelier yuniku is not liable for injuries or damage arising from improper use of the workshops, equipment or materials.

6.3 Insurance

atelier yuniku recommends that its members take out personal accident insurance as well as liability insurance that also covers damage arising in the course of activity in the atelier. atelier yuniku accepts no responsibility for accidents or damage caused by improper use or misconduct on the part of members.

7. Use and procurement of materials

7.1 Use of materials

Members may use materials in the workshop that are provided by atelier yuniku, provided these are included in the price of the membership or the respective service. For materials such as clay, glazes, paints or wood, additional costs apply, which are charged according to consumption. Current prices for materials are published regularly on the website.

7.2 Own materials

The use of one’s own materials is permitted only with the express consent of atelier yuniku. When using one’s own materials, it must be ensured that they are compatible with the equipment and facilities offered and pose no danger to other members or the equipment.

7.3 Damage to materials

Members are obliged to treat material they use in the workshop with care. Damage to the materials provided by atelier yuniku or to the workshop equipment must be reported immediately. The costs of repairing or replacing damaged materials may be charged to the member.

8. Course booking and conditions of participation

8.1 Course booking

Registration for courses and workshops is made via the atelier yuniku website or by direct booking at the workshop. A course or workshop is deemed booked once participation has been confirmed in writing. A registration is binding and entails the obligation to pay the full course fee.

8.2 Cancellation, refunds and course changes

Cancellations and refunds by the customer, passing your spot to a replacement participant, and the cancellation or modification of courses by atelier yuniku are governed by our separate Cancellation Policy.

9. Disregard of studio rules

Members who repeatedly violate the studio rules or behave in a way that endangers the well-being or safety of other members may be excluded by atelier yuniku after a written warning. This also includes the repeated failure to meet payment obligations.

10. Data protection

10.1 Privacy policy

atelier yuniku undertakes to protect the personal data of members in accordance with the applicable data protection laws. All data is treated confidentially and used only for the administration of the membership and the organisation of courses and events. Details of data processing can be found in atelier yuniku’s privacy policy.

10.2 Disclosure of data

atelier yuniku does not pass on personal data to third parties unless this is necessary for the performance of the contractual agreements or is required by law.

11. Final provisions

11.1 Changes to the Terms

atelier yuniku reserves the right to amend these Terms at any time. Changes will be communicated to members in good time and are deemed accepted if the membership continues to be used.

11.2 Place of jurisdiction and applicable law

Swiss law applies. The place of jurisdiction for all disputes arising from this contract is Zürich.
